Advising Japan Tobacco International on participating in national tobacco legislation modification process

Advising Japan Tobacco International (one of the world's largest tobacco manufacturers) on participation in the national tobacco legislation modification process concerning tobacco products' plain packaging issues. Evaluation of the proposal on plain packaging in relation to its compliance with the Constitution, European Community and international legislation and successful representation of the client in the legislative process. Evaluation required thorough analysis of the case law of the Constitutional Court, the European Court of Human Rights, and the European Court of Justice on protection of property (including intellectual property) rights, freedom of commercial activity, application of proportionality principle and other constitutional principles was required. The proposal on plain packaging was declared unconstitutional by the Committee on Legal Affairs of the Lithuanian Parliament and followed by refusal of enactment by the Parliament (Lithuania)
